1. Acceptance of Terms
By accepting a quote, signing an agreement, authorizing work verbally or electronically, or permitting Total Power Generation, LLC (TPG) to perform services, the customer agrees to these Terms and Conditions.
2. Scope of Services
TPG provides generator sales, installation, inspections, preventive maintenance, repairs, monitoring support, transfer switch services, and related electrical services. Services are limited to the approved scope of work.
3. Estimates, Quotes, Authorization & Change Orders
All quotes are valid for thirty (30) days unless otherwise stated. Pricing may be subject to change after expiration.
The individual or entity authorizing any estimate, quote, proposal, service call, repair, maintenance, or installation represents and warrants that they possess full authority to authorize the work described therein and agree to be bound by these Terms and Conditions.
The scope of work is limited to the services specifically identified in the approved quote. Any work outside the approved scope may require a change order and will be billed separately.
Additional freight charges, permit fees, engineering requirements, code compliance requirements, or material costs not reasonably identifiable at the time of quoting may be billed separately.
Parts ordered based upon customer authorization are non-refundable. If authorized work is canceled after parts have been ordered, the customer shall be responsible for all parts, freight charges, and any applicable restocking fees, as determined by TPG in its sole discretion.
4. Scheduling
Appointments may be rescheduled due to weather, hurricanes, utility interruptions, permitting delays, emergencies, parts availability, or other unforeseen circumstances.
5. Maintenance Agreements
Maintenance agreements are prepaid and become active upon enrollment. Once activated, agreement fees are non-refundable except where required by law. Repairs, replacement parts, and additional services are billed separately unless specifically included in the selected plan.
6. Payments, Collections & Fees
Payment is due in full upon receipt of invoice unless otherwise agreed in writing.
All work performed, including service agreements, maintenance agreements, diagnostics, repairs, labor, permits, engineering, and materials, is non-refundable.
Repair work and diagnostic charges cannot be credited toward the purchase of replacement equipment unless specifically agreed to in writing by TPG.
Any unpaid balance outstanding more than thirty (30) days shall accrue interest and service charges at the maximum rate permitted by applicable law.
The customer agrees to pay all reasonable collection costs incurred by TPG, including collection agency fees, court costs, lien-related expenses, and reasonable attorney's fees.
TPG shall have the right to file and enforce any mechanic's lien, construction lien, or other lien rights permitted under Florida law for unpaid labor, services, materials, equipment, permits, engineering, or related project costs.
Returned payments are subject to a $35 returned payment fee.
A convenience fee of 5% may be applied to credit card payments where permitted by law and disclosed before payment.
7. Customer Responsibilities & Site Access
Customers must provide safe, unobstructed access to all equipment and work areas.
Approval of a quote authorizes TPG, its employees, subcontractors, and representatives to access the emergency backup power system and associated equipment as reasonably necessary to perform the authorized work.
Failure to provide access to the equipment at the scheduled appointment may result in travel charges, a $50 cancellation fee, and rescheduling of the service visit.
Customers are responsible for maintaining adequate fuel supply and disclosing any known issues with the system.
Customers are responsible for providing any requested documentation, including utility usage records, surveys, HOA requirements, permits, or other information reasonably necessary for project completion.
8. Repairs, Warranties & Limitation of Liability
Power generation systems are complex mechanical and electrical systems. TPG cannot guarantee full operational functionality of any system following completion of repairs, maintenance, diagnostics, or replacement of specific components because additional defects or failures may exist that are not apparent until further testing or repair is performed.
TPG shall not be liable for unforeseen conditions, concealed defects, code violations, pre-existing deficiencies, manufacturer defects, utility issues, fuel supply issues, weather events, Acts of God, hurricanes, flooding, lightning, or circumstances beyond TPG's reasonable control.
Additional issues discovered during the course of service may require additional labor, materials, diagnostics, permits, engineering, or repairs. Such work shall be billed at TPG's then-current rates.
Additional labor is billed at: $165/hour for maintenance contract customers, $195/hour for non-contract customers, and $275/hour for emergency service.
Repairs specifically identified in the approved scope of work are warranted for ninety (90) days from completion for proper workmanship and functionality of parts installed by TPG.
This warranty does not cover abuse, misuse, neglect, Acts of God, utility issues, fuel contamination, manufacturer defects, normal wear and tear, or failures unrelated to the specific repair performed.
Manufacturer warranties remain subject solely to the manufacturer's terms and conditions.
9. Installation-Specific Exclusions
Landscaping after trenching is by others. Pavers, trees, bushes, plants, grass, irrigation, decorative stone, and similar site restoration are excluded unless specifically listed in the quote.
Drywall repair, painting, stucco repair, and finish work are excluded unless specifically listed in the quote.
Existing systems are assumed code-compliant unless otherwise noted. Any code deficiencies discovered may require additional work and charges.
Floodplain, elevation, engineering, permitting, HOA, or utility requirements discovered after quoting may result in additional charges.
Lead times are estimates only and are not guaranteed.
Once equipment has been ordered, the project is non-refundable.
The client is responsible for obtaining permits and inspections unless specifically included in the quote.
10. Communications & Electronic Consent
Customers agree that TPG may communicate by telephone, email, and SMS/text message regarding requested services, appointments, invoices, estimates, maintenance reminders, financing information, and promotional communications where consent has been provided.
11. Privacy
TPG does not sell or share customers' mobile phone numbers with third parties for their independent marketing purposes. Customer information is used only for legitimate business purposes.
12. Electronic Signatures
Electronic signatures, Jobber approvals, electronic approvals, and other electronic authorizations shall be considered legally binding to the fullest extent permitted by law.
13. Governing Law
These Terms and Conditions shall be governed by the laws of the State of Florida.

The Pro Plan provides quarterly visits, enhancing generator care with more comprehensive services. Customers also get 24/7 monitoring with device purchase, a 15% discount on parts, discounted labor rates, and an 8-hour response time guarantee.
Premier Plan
The Premier Plan delivers monthly visits and the highest level of service. It includes all Pro Plan services plus yearly power washing and waxing, unlimited diagnostic calls, enclosure UV protectant, UV oil leak detection, free belt changes, dielectric grease application, and no charge top-ups. Customers benefit from a 25% discount on parts, discounted labor rates, and a 4-hour response time guarantee, ensuring top priority service.
Points of Inspection
Inspections cover critical areas to ensure generator performance. Fuel checks include examining fuel lines, connections, and levels. Electrical inspections involve checking wiring, testing and cleaning the battery, and measuring voltage and load amps. Cooling assessments focus on the coolant level and enclosure louvers. Various Tests include starting and exercising the generator, simulating power failure, changing engine oil, replacing filters, and checking spark plugs. The Engine & Mounting section includes reading the hour meter and inspecting air cleaners, spark plugs, belts, hoses, and clamps. These inspections ensure the generator runs optimally.
